The victory of all five NDA candidates—two from BJP, two from JDU, and one from RLM—has brought a constitutional ticking clock to the CM's office. Nitish Kumar now finds himself at a crossroads where he must choose between his new Rajya Sabha seat and his current MLC position by March 30.

The March 30 Ultimatum: A Constitutional Deadlock

Under Article 101(2) of the Indian Constitution and the Representation of the People Act, a leader cannot hold seats in both Parliament and the State Legislature simultaneously. Since Nitish Kumar was declared elected to the Rajya Sabha on March 16, he has exactly 14 days to make a decision.

If he does not resign from the Rajya Sabha by March 30, his Bihar Legislative Council (MLC) membership will automatically expire. While he can technically remain Chief Minister for six months without being a member of either house, this move would signal a significant transition in his political career.

The Rajya Sabha election results highlighted the BJP's growing strategic control in Bihar. Despite the Mahagathbandhan's efforts, the NDA managed to secure the fifth seat through clever management of first and second-preference votes.
